1. Agreement and service scope
These Terms of Service ("Terms") are a binding agreement between you and the developer or publisher identified as the seller of FaceEnjoy in the App Store or Google Play listing from which you obtained the app ("FaceEnjoy," "we," "us," or "our"). By downloading, accessing, purchasing through, or using FaceEnjoy, you agree to these Terms and our Privacy Policy.
The Service is intended for international distribution outside mainland China and is not offered for distribution in mainland China. If you do not agree, do not use the Service. Some features may have additional disclosures or rules presented when you use them; those terms form part of this agreement.
2. Eligibility
You must be at least 13 years old, or the higher minimum age required in your country, to use the Service. If you are not legally an adult where you live, a parent or legal guardian must review and agree to these Terms and supervise your use. You represent that you are legally permitted to use the Service and are not barred by sanctions, export controls, or other applicable law.
3. Accounts and recovery
FaceEnjoy may create an anonymous account when the app first starts so that points, purchases, moderation policy, and works can be associated with a stable service identity. You may add a verified recovery email or recovery code. Some paid features may require an account-protection method so purchases can be restored.
You are responsible for your device, recovery email, recovery code, and activity under your account. Do not transfer, sell, or share account credentials. Device-based reinstall recovery is best effort and is not guaranteed after a device reset, platform-account change, missing platform services, or secure-storage loss.
You may delete your account in the app or through the deletion page on faceenjoy.com. Deletion is permanent. It does not cancel an Apple or Google subscription and does not remove files you already saved to your device or shared with others.
4. Limited license
Subject to these Terms, FaceEnjoy grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the Service for lawful, non-commercial personal creative use on devices you own or control, except where a store's family-sharing rules permit otherwise.
You may not copy, distribute, sell, sublicense, rent, reverse engineer, decompile, bypass security, extract models, scrape the Service, interfere with its operation, or use its APIs except as expressly allowed by law or written permission from FaceEnjoy.
5. Your content and permission to process it
You retain any rights you already hold in photos, prompts, feedback, and other content you provide ("Your Content"). You grant FaceEnjoy and its service providers a worldwide, non-exclusive, royalty-free, limited license to host, copy, transmit, transform, moderate, and otherwise process Your Content only as needed to provide, maintain, secure, and support the Service features you request, enforce these Terms, and comply with law.
This license ends when the relevant content and account records are deleted, except to the extent content remains in lawful backups, security or transaction records, a report under review, or content you shared outside FaceEnjoy. We do not claim ownership of Your Content merely because you use the Service.
6. Photos, faces, consent, and third-party rights
You may use only photos and faces that you own or are legally authorized to use. Before editing another person's face, obtain all permissions and consents required by the laws that apply to you and the intended use. You are solely responsible for rights of publicity, privacy, copyright, trademark, and other rights in Your Content and outputs you save, publish, or share.
Do not present a face swap as authentic, use it to deceive others, or imply a person's endorsement, conduct, or statements without authorization. When context could mislead a reasonable viewer, clearly disclose that the image was edited or AI-generated.
7. Prohibited use
You must not use the Service to violate law or another person's rights, facilitate wrongdoing, or create or distribute harmful content. Prohibited uses include the following:
- Fraud, impersonation, identity theft, deceptive endorsements, phishing, extortion, harassment, stalking, threats, defamation, or election and public-safety deception.
- Non-consensual intimate imagery, sexual exploitation, sexual content involving minors, grooming, trafficking, or any content that endangers a child.
- Hateful, violent, terrorist, extremist, or criminal content; instructions to cause serious harm; or attempts to evade safety controls.
- Infringement of copyright, trademark, privacy, publicity, contractual, confidentiality, or other rights.
- Uploading malware, attacking the Service, abusing refunds or rewards, automating accounts, manipulating purchases, or attempting to discover another user's data.
- Using outputs as the sole basis for high-impact decisions about employment, credit, housing, insurance, education, healthcare, legal services, or access to essential services.
8. AI features and content moderation
Face swaps and AI-generated images may be inaccurate, unexpected, similar to other outputs, or unsuitable for your intended purpose. Outputs are not professional advice or proof of fact. You must review an output before using or sharing it and comply with any disclosure or labeling rules that apply where you publish it.
We may use automated content-safety systems and human review of reports. We may block a request, refuse an output, remove stored content, restrict features, preserve relevant records, or suspend or terminate an account when we reasonably believe content violates these Terms, provider rules, store requirements, or law. Automated systems can make mistakes; available feedback channels may be used to request review.
Cloud AI generation requires a separate disclosure and consent. Prompts and generated results may be processed by ModelVerse and the selected model provider. Do not submit secrets or personal information you are not authorized to disclose.
9. Purchases, subscriptions, and points
Purchases are processed by Apple App Store or Google Play under the store terms attached to your account. Prices, taxes, billing periods, renewal terms, and any introductory offer are shown before purchase. An auto-renewing subscription continues until canceled through the relevant store at least as required by that store. Deleting FaceEnjoy or your FaceEnjoy account does not cancel a store subscription.
Points are a limited, personal, revocable license to access eligible in-app features. They are not money, stored value, property, or transferable, and they have no cash value except where law requires otherwise. Points may be purchased, granted with a subscription, awarded, spent, refunded, reversed after a chargeback, or adjusted to correct an error. A refund or revoked transaction may make a balance negative, and later grants may first offset that balance.
Except where required by law or store policy, completed consumable-point purchases and points already spent are non-refundable. Refund requests and subscription management must generally be submitted to Apple or Google. If a verified payment is not reflected correctly, contact support@faceenjoy.com with the store order information, but never send full payment-card details.
10. FaceEnjoy intellectual property
The Service, software, interface, branding, documentation, templates supplied by FaceEnjoy, face-engine technology, and all related intellectual property are owned by FaceEnjoy or its licensors. These Terms do not transfer ownership to you. Feedback and suggestions may be used without restriction or compensation, provided we do not publicly identify you without permission.
AI output may not qualify for intellectual-property protection and may resemble content generated for others. FaceEnjoy does not promise that an output is unique, registrable, non-infringing, or available for commercial use. Your rights in an output, if any, depend on applicable law, the rights in your input, and relevant provider terms.
11. Third-party services
The Service relies on third parties such as Apple, Google, Supabase, Vercel, Cloudflare, Alibaba Cloud, ModelVerse, selected AI providers, and content or model delivery providers. Their services may have separate terms and privacy notices. FaceEnjoy is not responsible for a third-party service that you access independently, but we remain responsible for our own obligations when a provider processes information on our behalf.
Links, templates, or materials from third parties do not imply endorsement. You must comply with any license or usage restriction that accompanies third-party content.
12. Availability and changes
The Service may require a compatible device, Internet access, model downloads, available providers, and a supported store region. Detection quality and output quality vary with the device, image, lighting, angle, occlusion, prompt, and model. We do not promise uninterrupted availability or that every feature will remain available in every country or on every device.
We may update, add, limit, or discontinue features for security, legal, provider, technical, or business reasons. If a change materially reduces a paid ongoing service, we will provide any notice, remedy, or refund required by law or store policy.
13. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially or repeatedly breach these Terms, create risk or legal exposure, abuse purchases or safety systems, or if required by a platform or law. Where reasonable and lawful, we will provide notice and an opportunity to appeal or export eligible information.
Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, dispute terms, and lawful retention—will continue to apply.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." FACEENJOY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY OUTPUT WILL BE ERROR-FREE, SECURE, UNIQUE, LEGAL FOR YOUR INTENDED USE, OR CONTINUOUSLY AVAILABLE.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACEENJOY AND ITS LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, BUSINESS, OR OPPORTUNITY, ARISING FROM THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACEENJOY'S TOTAL LIABILITY FOR ALL CLAIMS ARISING DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY WILL NOT EXCEED THE GREATER OF US$50 OR THE AMOUNT YOU PAID TO FACEENJOY THROUGH THE RELEVANT STORE DURING THAT PERIOD. This limit does not apply to liability that cannot legally be limited, including where applicable liability for fraud, willful misconduct, or death or personal injury caused by negligence.
16. Your responsibility for claims
To the extent permitted by law, you will defend, indemnify, and hold FaceEnjoy harmless from third-party claims, losses, and reasonable costs arising from Your Content, your unlawful or unauthorized use of a person's face or other rights, or your material breach of these Terms. This obligation does not apply to the extent a claim was caused by FaceEnjoy's own breach or misconduct.
17. Governing law and disputes
Before filing a formal claim, you and FaceEnjoy agree to try in good faith for 30 days to resolve the issue by contacting support@faceenjoy.com. Include a description of the dispute and the remedy requested, but do not send sensitive photos unless requested through a secure support process.
These Terms are governed by the laws of the jurisdiction in which the FaceEnjoy seller or developer shown on your applicable storefront is established, without regard to conflict-of-laws rules. Courts with lawful jurisdiction over that operator may hear disputes. If you are a consumer, this choice does not remove mandatory protections or your right to bring a claim in any forum available under the law of your place of residence. We do not require individual arbitration or waive class remedies where such a requirement would be unlawful.
18. Apple and Google store terms
If you obtained FaceEnjoy from Apple, these Terms are between you and FaceEnjoy, not Apple. Apple has no obligation to provide maintenance or support and is not responsible for claims relating to the app, except as required by law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the license terms against you. Your use must comply with the App Store terms, including any usage rules.
If you obtained FaceEnjoy from Google Play, your use must also comply with Google Play's applicable terms. Google is not responsible for FaceEnjoy support. Store terms control store billing, refunds, distribution, and subscription management where they conflict with these Terms.
19. Changes, general terms, and contact
We may update these Terms to reflect changes to the Service, providers, law, or risk. We will post the revised Terms with a new date and provide additional notice when required. Continued use after the effective date constitutes acceptance where permitted; if applicable law requires express consent, we will request it.
If any provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, or transfer of the Service, subject to applicable notice requirements.
